General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) define the terms under which CCM 3P Consulting Ltd (hereinafter "the Seller") makes its trainings and services available through the website lesformationspriveesduccm3p.com. By subscribing, for a fee or free of charge, to any product and/or service presented on the site, you (hereinafter "the Customer") confirm that you accept all of these provisions without reservation.

If you do not accept these General Terms and Conditions, you may not benefit from the site's services. The Seller reserves the right to amend these GTC at any time; the applicable terms are those in force on the date of the order.

Article 0 — Identity of the seller

Article 1 — Definitions

  • "Training" or "session": a finished digital work or live professional support, represented by one or more digital files and/or access to an online viewing platform.
  • "Platform": all of the pages and services accessible on lesformationspriveesduccm3p.com.
  • "Digital file": a computer file enabling a work to be represented on an electronic device.

Article 2 — Purpose

These are the general terms and conditions of the trainings offered for download and/or streaming by the Seller. Validating payment of the order constitutes unreserved acceptance of these terms. Unless proven otherwise, the electronic records kept by the Seller constitute proof of the transactions.

Article 3 — Modification of the offer

The Seller reserves the right to make any modifications and improvements to its offer that it deems useful, and to discontinue an offer, without incurring any liability in this respect.

Article 4 — Purchase process

To benefit from the services, the Customer selects their training on the Platform and provides the necessary information (full name, address, phone, email) in order to receive the order confirmation and access credentials. The Customer declares that they are at least 18 years old and have the legal capacity to make the payment.

After payment is validated, access to the training is granted on a personal basis, for the duration indicated on the sales page according to the type of training. Access and content are strictly personal; any recording on an external medium or any redistribution is prohibited. The content is delivered electronically to the email address provided when ordering.

Article 5 — Price and payment

Prices are stated in euros. Any applicable taxes are specified when ordering and on the invoice, in accordance with the regulations in force. The Seller reserves the right to change its prices at any time; the training is invoiced at the rate in force at the time the order is validated.

Payment is made at the time of the order by bank card through the secure payment provider MIPS. The Seller does not have access to card data, which is processed and secured by the provider. Payment in several instalments may be offered. The Seller reserves the right not to offer a payment method for any legitimate reason (previous non-payment, suspicion of fraud).

Article 6 — Right of withdrawal

For consumer Customers residing in the European Union, the mandatory consumer-protection provisions of their country of residence remain applicable, in accordance with Regulation (EC) No 593/2008 (Rome I).

The consumer Customer is in principle entitled to a fourteen (14) day withdrawal period for distance contracts. However, for digital content supplied immediately, the Customer expressly acknowledges and agrees, by validating their order, that performance begins as soon as access is opened and consequently waives their right of withdrawal once access is opened. As long as access has not been delivered, the right of withdrawal may be exercised by an unambiguous statement sent to assistant@lesformationspriveesduccm3p.com.

Where withdrawal is validly exercised, the Seller reimburses the sums due without undue delay, and no later than within fourteen (14) days.

Article 7 — Evidence

Unless proven otherwise, the data recorded on the Customer's account constitutes proof of all of their orders.

Article 8 — Liability

The Seller's obligations are best-efforts obligations. The Seller cannot be held liable for the limitations of the Internet network, for malfunctions beyond its control, or for any loss of data or damage to the Customer's equipment. It is the Customer's responsibility to protect their equipment. In the event of access difficulties, the Seller undertakes to use its best efforts to restore access. The extent of the Seller's liability is limited to the amount of the order concerned.

Article 9 — Intellectual property

All trademarks, logos, content, texts, images and videos remain the exclusive property of CCM 3P Consulting Ltd or its licensors, and are protected by the applicable laws and international treaties. Any unauthorised use is prohibited.

Article 10 — Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of these terms. The Seller complies with the GDPR for EU residents and with the Mauritian Data Protection Act.

Article 11 — Governing law and dispute resolution

These GTC are governed by Mauritian law. However, where the Customer is a consumer residing in the European Union, they additionally benefit from the mandatory consumer-protection provisions of their country of residence, which cannot be set aside by this clause.

In the event of a dispute, the parties shall endeavour to reach an amicable solution. An EU-resident consumer Customer may use the European online dispute resolution platform (https://ec.europa.eu/consumers/odr) or a consumer mediator competent in their country. Failing an amicable resolution, the competent courts shall be determined in accordance with the public-policy rules applicable to the consumer Customer.

Article 12 — Amendment of the GTC

The Seller reserves the right to amend these GTC at any time. The terms applicable to an order are those in force on its date.
